Program Description:
On January 12th, the Federal Reserve Board approved a final rule amending Regulation Z (Truth in Lending) which implements provisions of the Credit Card Accountability Responsibility and Disclosure Act of 2009 (“CARD Act”) that will go into effect on February 22, 2010.This rule represents the second stage of the Board’s implementation of the CARD Act.
Card issuers will have little implementation time before the final CARD Act Rules go into effect on February 22, 2010. The Act places special emphasis on regulators to be accountable for enforcement of the law and contains increased penalties for card issuers that violate these new restrictions.
The remaining provisions of the CARD Act go into effect on August 22, 2010 and the Board has released proposed gift card rules and is expected to release proposed rules implementing other provisions in the near future. The Teleseminar will also discuss the final overdraft regulations recently released by the Board.

- Requirements to obtain a consumer’s consent before charging fees for transactions that exceed the credit limit;
- Prohibitions against assessing finance charges on partial payments made by consumers eligible for that grace period;
- Prohibitions against allocating payments other than as required by the CARD Act;
- Limitations on assessing certain fees associated with subprime credit cards; and
Prohibitions against using the double-cycle billing method.
