The California Civil Rights Council met on February 21, 2023. Two of the items on the agenda of interest for employment screening, items VIII and IX. CDIA filed a comment in connection with these agenda items.

At the February 21 hearing, the Civil Rights Council voted to move its Proposed Modifications to Employment Regulations Regarding Automated-Decision Systems to the formal rulemaking process. The regulations will be proposed as they appear in the linked document, except for a nonsubstantive update to fix a typographical error. The next step will be for the Council to draft a statement of reasons for the rulemaking and post the notice of proposed rulemaking in the California Register. At that point, the 45-day public comment period will open.
