On Oct. 10, 2022, the Colorado Attorney General’s Office (Department of Law) published its much-anticipated proposed rules (Proposed Rules) implementing the Colorado Privacy Act (CPA). The proposal would add new provisions to the Colorado Code of Regulations, 4 CCR-904-3.

The CPA was enacted in July 2021, following the passage of S.B. 190. The law is scheduled to go into effect on July 1, 2023. The Proposed Rules provide significant new detail and context for a number of obligations created by the CPA and would require companies to do a great deal of work to come into compliance. There are similarities and differences between the CPA rulemaking and the California rulemaking under the CCPA.
