Credit Repair Organizations Act (CROA) (15)

113th Congress

H.R. 5446, the Facilitating Access to Credit Act of 2014 by Red. Ed Royce (R-CA). This bill would amend the Credit Repair Organizations Act (CROA) to

(1) Exempt from its coverage any consumer reporting agency (or affiliate or subsidiary) described under the FCRA as (a) one that compiles and maintains files on consumers on a nationwide basis; or (b) any person which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information on consumers in order to furnish consumer reports to third parties, if the person is subject to supervision and examination by the CFPB.

(2) Preempt state law and regulations concerning a credit repair organization to the extent they would apply to consumer reporting agencies subject to this Act.

(3) Direct the FTC to study whether, in addition to these persons, any other person should be exempt from the Credit Repair Organizations Act.

114th Congress

H.R. ____, the Facilitating Access to Credit Act by Red. Ed Royce (R-CA). This bill would amend the Credit Repair Organizations Act (CROA) and “creat[e] a regulatory framework for authorized credit service providers to offer personalized credit education and identity theft protection services under the watch of the Federal Trade Commission.” The credit repair bill ultimately became H.R. 347.

115th Congress

H.R. 6192, the Credit Services Protection Act of 2018 by Red. Ed Royce (R-CA). This bill would amend the Credit Repair Organizations Act (CROA) to modify the “requirements for consumer credit services, including to exempt certain credit and identity protection services from compliance with the Credit Repair Organizations Act.

117th Congress

H.R. 7919 by Rep. Al Lawson (D-FL). This bill would amend the FCRA to permit certain credit repair organizations to dispute credit information directly with a furnisher.

H.R. 1257 by Rep. Frank Pallone (D-NJ). The Homeless Veterans CREDIT Act would require the Department of Veterans Affairs to conduct a comprehensive study on access to, and use and effects of, financial and credit counseling for homeless veterans and veterans experiencing housing instability.
