In August 2023, U.S. Sen. Sherrod Brown (D-OH), the Chair of Senate Banking, sent a letter to FHFA in response to its RFI on multifamily tenant protections. Joining Senator Brown on the letter are Senators Jack Reed (D-RI), John Fetterman (D-PA), Mark Warner (D-VA), Tim Kaine (D-VA), Richard Blumenthal (D-CT), Elizabeth Warren (D-MA), Ed Markey (D-MA), Alex Padilla (D-CA), Patty Murray (D-WA), Sheldon Whitehouse (D-RI), Bob Casey (D-PA), Brian Schatz (D-HI), Bernie Sanders (I-VT), Catherine Cortez Masto (D-NV), Chris Van Hollen (D-MD), and Tammy Duckworth (D-IL).

Among other things, the Senators urged FHFA to: “prohibit discrimination based on source of income and prohibit presumptive exclusion of applicants based upon information in tenant screening reports such as prior eviction or credit score.” The Senators urged FHFA to require “[t]imely provision of any tenant screening report used by an owner or manager to an applicant for housing upon request.”
