In October 2023, CDIA filed a comment with the Texas Office of the Secretary of State (SOS) to implement the data broker registration requirements in Senate Bill 2105 (S.B. 2105).
In 2023, the Office of the Secretary of State (Office) proposed a new Chapter 106, §§106.1 – 106.5, concerning registration of data brokers. 48 Tex. Reg. 5593 (Sept. 29, 2023). The Office proposes these rules to implement the new registration requirements for data brokers in Senate Bill 2105, enacted by the 88th Legislature, Regular Session, codified at Chapter 509 of the Texas Business and Commerce Code (S.B. 2105).
The regulation would create a new Chapter, Chapter 106 (Registration of Data Brokers) in Title 1 (Administration), Part 4 (Office of the Secretary of the State).
