In March 2023, a number of advocates petitioned the Wisconsin Supreme Court to amend SCR 72.01(8), 72.01(9), and 72.01(10), relating to the retention of small claims case files, court records, and minute records. These rules are all found in Chapter 72, retention of court records. The petition was initiated by Legal Action of Wisconsin which added a memorandum to its petition. In general, the petition was “to shorten the record retention period for eviction cases in which no money judgment is entered to one year.”
The Supreme Court held a hearing (audio) on the rules change in September 2023 and scheduled another hearing in December 2023.
