In February 2024, the CFPB and the FTC filed an amicus (February 7, 2024) to the U.S. Court of Appeals for the 3rd Circuit in another case involving legal versus factual disputes. That case is Ritz v. Nissan, No. 23-2181.

The case is on appeal from the U.S. District Court for the District of New Jersey. There U.S. District Court Judge Georgette Castner issued a Memorandum Opinion (May 30, 2023) granted the Defendant’s (Nissan Motors) motion for summary judgment and dismissed the Plaintiff’s (Ritz) claim with prejudice.
