In March 2024, the CFPB announced that it and the FTC filed an amicus in Nelson v. Experian Information Solutions, Inc., a case pending in the 11th Circuit. According to the Bureau’s summary, its brief argues that the FCRA’s requirement that CRAs must “conduct a reasonable reinvestigation” of disputed information “applies to consumer disputes concerning personal identifying information contained in the consumer’s file, such as names, addresses, and Social Security numbers. The brief also argues that Experian’s contrary interpretation was not based on the text of the FCRA, prior case law, or guidance from the CFPB or the FTC. Experian therefore should not be allowed to escape liability for failing to investigate the consumer’s disputes [in this case].”

CDIA filed an amicus in the case.

In August 2023, as reported by Law 360, “Experian was granted summary judgment in a proposed class action alleging it violated the Fair Credit Reporting Act by failing to correct inaccurate personal information on a consumer’s credit report, with the court declaring it was not “unreasonable” for Experian to have believed it had no duty to reinvestigate the plaintiff’s claims.”
