The Subcommittee on Workforce Protections of the House Committee on Education and the Workforce announced another oversight hearing of the EEOC.  The September 17 hearing will focus on three EEOC reform bills: H.R. 4959, the EEOC Transparency and Accountability Act; H.R. 5422, the Litigation Oversight Act of 2014; and H.R. 5423, the Certainty in Enforcement Act of 2014.

Testifying were Lynn A. Clements, Director of Regulatory Affairs at Berkshire Associates, Inc. in Columbia, MD; Eric S. Dreiband, a partner at Jones Day in Washington, DC (and a former general counsel at the EEOC); Michael L. Foreman, Director, Civil Rights Appellate Clinic at the Pennsylvania State University, Dickinson School of Law in State College, PA; and William F. Lloyd, the general counsel at Deloitte LLP in New York.


This is third EEOC oversight hearing in the last few years.  On June 10, the subcommittee held a hearing, “The Regulatory and Enforcement Priorities of the EEOC: Examining the Concerns of Stakeholders”.   You can read the press release announcing the hearing.  Also available is the written testimony of the Sue Weaver CAUSE, NAACP Legal Defense and Education Fund, the National Small Business Association, and the U.S. Chamber of Commerce.  The Chamber also presented at the hearing, a paper entitled A Review of Enforcement and Litigation Strategy during the Obama Administration—A Misuse of Authority.  Todd McCracken for the NSBA noted a March 2011 BJS survey on workplace violence from 1993-2009.

The first in the latest series of oversight hearings began on May 22, 2013 when the House Subcommittee on Workforce Protections held a hearing, “Examining the Regulatory and Enforcement Actions of the Equal Employment Opportunity Commission.”  The sole witness was EEOC Chairwoman, Jacqueline Berrien.  The committee print of that hearing is available online.
